What does the bundle include?

  • Employee Agreement - Sets out the terms and conditions upon which the owner of a business engages an employee to work in their business
  • Independent Contractor Agreement – Sets out the terms and conditions upon which the business owner (referred to as the “principal”) engages a service entity (the “contractor”) to provide services to the business.

Do I need these documents?

Yes. If you are hiring staff, it is important you have agreements in place to outline the terms of engagement. It is important to know the difference between an employee and a contractor and that you choose the appropriate arrangement. See below for more information.


What’s the difference between and Independent Contractor and an Employee?

Independent contractors generally:

  • work for themselves /are their own boss
  • can accept or refuse work
  • control their own working times
  • provide their own equipment
  • have no guarantee of future work
  • are responsible for paying their own super and income tax

Employees generally:

  • work in someone else’s business
  • are subject to controls on how, where and when they do their work
  • are paid a wage
  • have the expectation of ongoing work
  • receive employee entitlements, such as annual leave


What is sham contracting?

Sham contracting arrangement is when an employer attempts to disguise an employment relationship as an independent contracting arrangement. This is usually done to avoid paying employee entitlements such as super and income tax. Even if the contractor says they prefer a contractor arrangement, if the actual engagement is more reflective of an employee relationship, or even if you make an innocent mistake, you can still be hit with a fine as well as a back-payment of wages and entitlements.

What do I do once these templates are completed?

Once completed, you provide a copy to the employee or contractor you are hiring/engaging. Once in agreed form, both parties execute the agreement.

Varies depending on the template. But the entire bundle should only take 25-35mins.


How often are the templates updated?

We  are constantly updating and adding to our template library . We may update minor wording and formatting in our documents from time to time.
