What are website terms of use?

Website Terms of Use sets clear rules for all people visiting and accessing your website, regardless of whether they buy something from you or otherwise become a client.

This document is designed to protect you from certain legal risks and limit your legal liability to users of your Website if something goes wrong.


Do I need it?

While not strictly legally required, if you have a website, then you should have website terms of use for the following reasons:

  • Let’s visitors know what they can and cannot do with your website
  • Limits your liability if something goes wrong , if your visitors rely on information or links on your website.
  • Protects your intellectual property by letting visitors know what they can and cannot do with content you post on your website.

What’s the difference between Website Terms of Use and Website Terms and Conditions?

This document is different to your Terms of Sale. With Terms of Sale, you describe all the rules around clients buying products and/or services from you such as payment terms, cancellation, refunds, guarantees and warranties. Often you will see Terms of Sale posted on a website either separately or combined with the Website Terms of Use. We believe it is better practice to keep these two documents separate – one set of rules for visitors, and one set of rules for clients/purchasers.

Where do I publish it?

Once you have completed our Website Terms of Use template, you can publish it on your website as a new page and link to it in the footer, usually along with your Privacy Policy.
